Overtime Withholding Rules for Employers Under the One Big Beautiful Bill Act

The One Big Beautiful Bill Act (OBBBA) creates a temporary deduction for qualified overtime compensation from 2025 through 2028, but employer withholding rules remain largely unchanged. Overtime wages are still subject to federal income tax, Social Security, and Medicare. However, new W-2 reporting requirements beginning in 2026 require employers to separately track and report the FLSA overtime premium portion.
