Soter announced that it has filed a lawsuit in the Southern District of New York alleging that IP Video Corporation, A+ Technology & Security Solutions, Inc., and Advance Convergence Group, Inc. (Defendants) have engaged in cybersquatting, trademark infringement and unfair competition.

The legal action surrounds the alleged use of Soter’s registered FlySense trademark to advertise Defendants’ vape and bullying detector and service.

After noting that Defendants used the domain name www.flysense.com to advertise and offer for sale their own vape and bullying detecting sensor device, the court issued a temporary restraining order restraining Defendants from resuming operation of the domain name, which was allegedly used for approximately ten months in 2019 and 2020.

The court further restrained Defendants from stating that their sensor device is compatible with FlySense’s proprietary software platform.

Among other relief, the lawsuit seeks damages and a permanent injunction to prevent IP Video, A+ and ACG from making false statements about FlySense’s, or engaging in cybersquatting, infringement of Soter’s FlySense trademark, or unfair competition against Soter.
